Mitchell Epner, a New York defence attorney, sees “two potential issues for Andrew. One is reputational, the other is legal,” he said. His legal exposure appeared to narrow in November, Epner said. New York’s Adult Victims Act had allowed victims of sexual abuse a window of time in which to sue, in cases otherwise barred by the statute of limitations. Sjoberg could perhaps have sued the Duke of York, alleging that he sexually abused her.
She did not, and the window closed. However, Epner felt that Andrew would still be well advised to avoid travelling to America. “There would have to be something exceedingly important for him to come to the United States,” he said.
He added that the potential exposure, for Andrew, and anyone else, was less the substance of the documents themselves than in how they are perceived by the general public, and whether they cause anyone else to come forward.
The material in the documents “is already known to prosecutors but not known to the world at large,” he said. “Suppose it causes a person Z to read it and say, ‘Wait, that happened to me too’, and come forward to make allegations.”
