I appeared on the latest episode of Legal Eagle to discuss the charging decisions by the Manhattan DA’s office (New York State) and the United States Attorney’s Office for the Southern District of New York (Federal) with regard to Luigi Mangione and the killing of UHC CEO Brian Thompson.
TL;dr -
1. The Manhattan DA’s first degree murder indictment may have found the one crime for which Mr. Mangione has a good defense, because of the particular definition of “terrorism” under New York Law; and
2. The federal charges against Mr. Mangione almost certainly mean that the Trump DOJ will seek the death penalty, a punishment not available under New York law.
